Guidelines for Placement of Materials on E-Reserve
Faculty Electronic Reserves Procedure
 
 

The Library now has two forms of reserves: the traditional hard copy and the new electronic version (ERes). Below you will find guidelines for placing material on reserve. Some of these guidelines are new. For more information call the Reserves Desk at 610-361-5216.

 
 

COPYRIGHT LAWS WILL BE STRICTLY ENFORCED

 

Section 107: Copyright Act of 1976. Limitations on exclusive rights: Fair Use:

Not withstanding the provisions of sections 106 and 106a, the fair use of a copyrighted work, including such use by reproduction in copies or phonographic records or by any other means specified in that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright.

In determining whether the use made of a work in any particular case is a "fair use", the factors to be considered shall include:
* the purpose and character of the use
* the nature of the copyrighted work being used
* the amount and substantiality of the work being used
* the effect of the use on the market for value of the original

 

Guidelines for Placement of Materials on E-Reserve

 

These guidelines do not apply to entire books or videos to be placed on regular Reserve (not electronic) that are owned by either Neumann College Library or by the requesting faculty member. See the Library's Regular Reserves Policy for more information.

 

1) Faculty must conform to the Fair Use Guidelines. The following use of copyrighted material is permissible according to those guidelines:
* one chapter from any one book
* one poem, short story, or essay from a collected work
* one article from any one journal issue or newspaper
* a short excerpt not to exceed 10% of a work without chapters or articles
* a chart, graph, diagram, drawing, cartoon or picture from a book, periodical or newspaper

 

2) Material that will be placed on Reserve without obtaining copyright clearance includes the following:
* Quizzes/Exams/Solutions
* Homework assignments
* Study guides/syllabus prepared by instructor
* Lecture notes
* Student papers (with written authorization)
* Government publications
* Overheads prepared by the instructor

 

Reserve materials should make up a small percentage of required course readings.

 

Materials used for more than one course at the same time or for more than one semester DOES NOT conform to the above guidelines and must have copyright clearance.

 
 

Faculty Electronic Reserves Procedure

 

1) Instructors will need to set up an account to use the Electronic Reserves. Please call the Reserves Desk to make an appointment. Phone: 610-361-5216 during the following hours: M, W-F 8-5; Tu 12-8; or contact the Library Director.

 

2) Instructors will be responsible for the control of their own course materials. Designated Library staff members and some peer volunteers will be available to guide new faculty through this process.

 

3) For instructors enlisting the assistance of the Library staff in the placement of E-Res materials, there will be a limit of 10 copyrighted articles/chapters per course, per semester on Electronic Reserve. This restriction is due to the labor intensive nature of processing. Faculty may opt to control their own material upload, thus waving this restriction.

 

4) Articles/chapters to be placed on Electronic Reserve that are over 15 pages in length will be split into parts. Each part will consist of approximately 8 - 10 pages. Each part will count as one article/chapter.

 

5) Full bibliographic citations must be included with each article/chapter - even if it falls within the fair use guidelines. Proper attribution must be obtained for all works on Electronic Reserve. Faculty who wish to place a student paper or other unpublished work on reserve must obtain written consent from the author before the work will be added.

 

6) All materials to be scanned and added to Electronic Reserve must be clean, clear, 8 1/2" x 11" photocopies; paper-clipped, but not stapled.

 

7) Materials that do not follow the guidelines will be sent back to the instructor via campus mail. All materials will be added on a first come first serve basis. You will be notified if more than two days are required.

 

8) Passwords for each course using Electronic Reserve will be assigned by and given to the students by their instructor. The library will not provide these passwords to students.

 

Note: All Reserve materials will be removed and sent back to the instructor and all Electronic Reserve courses will be archived at the end of each semester. If you would like to keep the materials on reserve for an extended period, you must notify the Reserve Desk before the semester ends.
